Maralal court jails 60-year-old man for 20 years for raping daughter

A Maralal court has sentenced a 60-year-old man to 20 years imprisonment for raping his daughter.

The man was charged with raping his step-daughter aged 19 years on March17, 2016 at about 9.30pm in Jerusalem Village in Samburu East using force and intimidation.

In another charge, he was also accused of touching the complainant's body parts against her wish.

The prosecution informed the court that the complainant and her mother were the first to go to sleep before the dad later joined them.

The accused forcibly raped his daughter using intimidation, the court was told.

According to prosecution, the accused, his step-daughter and wife were sleeping in the same bed.

QUARREL ERUPTS

A quarrel erupted after the incident prompting the complainant and her mother to report the accused to Wamba Police Station.

The man was convicted to his own plea of guilty after he admitted to having committed the offence when he appeared before Principal Magistrate Charles Ndegwa.

According to a medical examination report from Wamba Catholic Hospital that was presented in court as an exhibit, a doctor recommended that the complainant be put on medical treatment for syphilis after she was raped by her father who tested positive for syphilis.

The patient told the doctor that she had had sexual intercourse with her step-father three times since 2015.

In the P3 form, the doctor said the patient (complainant) seemed to be mentally challenged.
