Livondo’s poll petition dismissed

A bid by a parliamentary loser to challenge the election of Prime Minister Raila Odinga flopped after High Court dismissed his case.

Judge Alnashir Visram dismissed the case filed by Mr Stanley Livondo saying the suit papers were not properly served on the Premier.

“I find and hold that the petition was not served upon first respondent (Mr Odinga) within the period of time prescribed by law and I strike it out,” said the judge.

Mr Livondo had said he tried serving the papers on Mr Odinga without success.

The judge expressed strong displeasure and objection to the decision by Mr Livondo visit to the Prime Minister’s House at night on a Saturday to serve the suit papers on him.

“I would wish to record my strong displeasure and objection to litigants chasing citizens at their homes at ungodly hours and over week-ends, ” said the judge.

He added: “Given the security situation in Kenya no person in his right mind is expected to open doors to strangers at night, or on early Sunday mornings. I find the practice despicable and hold that it doesn’t constitute due diligence.”

Mr Odinga had asked the court to dismiss the case filed by the PNU man.
