“Fake” doctor James Mugo Ndichu, alias Mugo wa Wairimu, has been sentenced to 29 years and six months by a Magistrate Court in Milimani for drugging patients to sexually assault them and running an illegal clinic.

Chief magistrate Wendy Kagendo said Mugo "is a danger to the society and ought to be kept away for a long time".

“He abused the knowledge he acquired on medical and health science to harm hapless women,” the magistrate said.

Not even Mugo’s mitigation that his parents are elderly and that he has a wife and a daughter, could move the court to hand him a lenient sentence.

The magistrate noted, Mugo, in his mitigation, only spoke about his university qualifications where he insisted that he is not a fake doctor as alleged by the Prosecutors and the Kenya Pharmacy and Poisons Board.

He said he is duly qualified and that the court case was a result of his “issues with the Kenya Pharmacy and Poisons Board”.

He avoided the issue of sexually assaulting sedated women at his clinic. He faced 12 counts related to sexual assault and operating an illegal health facility.

“Count two (in the charge sheet) is the main one. Having acquired knowledge in nursing he decided to administer drugs to patients and did despicable acts. He has not touched that. Court is at a loss to that. He endangered the lives of the patients mostly women. Most probably, rape was committed only that evidential threshold not met,” said the magistrate.

While sentencing Mugo the magistrate thrashed Mugo’s mitigation that his “ambition to serve the country as the health sector was still alive and was ready to pick it up again”.

In his mitigation, Mugo had stated that he wanted to serve humanity and he commenced the journey in 1996 when he was admitted at the University Of Nairobi College of Health Sciences to pursue a bachelor’s degree.

The court ruled that he deserved the custodial sentence because he is a danger to the society and he has to be kept away from the society by all means.

Mugo is currently serving another sentence of 11 years for operating an illegal clinic in Kayole area.

“I therefore order that in count two where Mugo was convicted for sedating a woman who he sexually assaulted, he is sentenced to 25 years less three years spent in remand. So he will serve 22 years," said Kagendo.

She did not give him an option of paying a fine since he had asked for lenient imprisonment terms instead of fines saying he had no capacity to raise money.
