The son of former president Daniel arap Moi has alleged a plot to derail the hearing and determination of a petition he filed against his estranged wife Rossana Pluda over upkeep dues.

Mr Philip Moi is fighting a pending warrant of arrest and being sent to civil jail for allegedly failing to pay maintenance dues to Ms Pluda.

In an affidavit presented to the High Court in Nairobi on Thursday, Philip Moi said he had paid more than Sh3 million for Ms Pluda’s upkeep since he was ordered to do so.

He now wants the “full statements of accounts” before any further directions are given in the case. A court last year ordered him to pay Sh500,000 every month.

No longer paying

Mr Moi was ordered to go to court on January 29 after Ms Pluda claimed he was no longer paying school fees and maintenance for their son.

In the affidavit, he says he was not aware of a pending warrant of arrest and that he has been complying with the court award “as a responsible parent”.

“I have exercised my parental responsibility honourably by nurturing my children in accordance with Christian values and principles, facilitating my children to obtain intellectual, moral, spiritual and other training,” says Mr Moi.

He cited the United Nations Covenant on Civil and Political Rights which he said protects him from being committed to jail for not fulfilling his obligations.
