Ex-cop back in court over Venezuela envoy Olga Fonseca murder

A former police officer charged with the murder of Venezuelan ambassador Olga Fonseca is set to take the stand over a confession he made after arrest.

Moses Kiprotich Kalya is expected to testify on the confession he made regarding an assassination plot against the ambassador.

High Court judge issued the directive Wednesday after three police officers, who were present at the time of his arrest and when the confession was made, testified.

Mr Kalya is charged alongside a former diplomat in the Venezuelan embassy Dwight Sagaray.

“The court will proceed with a trial within a trial where the fourth accused will testify based on his confession statement in order to determine whether the evidence can be accepted as the prosecution’s case,” said Lady Justice Roselyne Korir.

Mr Sagaray, who was the first Secretary at the embassy, his close friend Ahmed Mohamed and Kipngeno Kirui Chelogoi, Daniel Wafula Olonyi, Ahmed Mutiva, Alex Sifuma Wanyonyi together with the retired officer have been charged with the killing of the ambassador.

In the confession statement, Mr Kalya had claimed that he had met Mohamed through Mr Wanyonyi.

NUISANCE

He had allegedly confessed that Mohammed had mentioned that the deceased had to be eliminated since she had changed everything in the residence including workers and house keys.

The officer, who retired in September 2011 had claimed in his statement that Mohammed had told him that he had given Mr Wanyonyi Sh468,000 to do a certain job but he doubted whether he would do it.

He allegedly confessed that he had met Mr Wanyonyi and Mr Mohamed twice, at around 9.30pm and 12.30pm on the night Ms Fonseca was killed. She was murdered on July 26, 2012 .

He had further confessed that Mr Mohammed had given money to three other men that night on foot while he (Mohammed) drove a vehicle with diplomatic registration number plate..

He had claimed that Mohammed had said that “the newly posted lady was a nuisance because people at the embassy didn’t sleep and had changed drivers, cooks, flags but she was yet to know who they are”.

He claimed to have learnt of Ms Fonseca’s death from television news on July 27, 2012.
