Keriako Tobiko wants case against bank bosses thrown out

A case filed against National Bank chairman Mohammed Abdirahaman Hassan and managing director Munir Sheikh Ahmed was rushed to court before the police concluded investigations, a prosecutor said on Thursday.
Mr Victor Mule, a deputy prosecutor, said the Director of Public Prosecutions, Mr Keriako Tobiko, was opposed to a private prosecution against the two bank directors by a former senior employee.
Mr Mule and lawyers Cecil Miller and George Oraro for Mr Ahmed and Mr Hassan respectively, urged principal magistrate Enock Cherono not to allow former bank company secretary Leonard Gethoi Kamweti to proceed with the private prosecution case.
Mr Miller has filed an objection to the private case saying “he is acting in bad faith while the case is incompetent and devoid of merit”.
CONTEMPT OF COURT ORDER
He also told Mr Cherono that Mr Kamweti was “in flagrant contempt of a court order issued by Lady Justice Rose Ougo on January 16, 2014”.
Mr Oraro has also attacked the intended criminal prosecution, saying “it is contrary to public policy and interest and is actuated by malice on the part of Mr Kamweti”.
Mr Kamweti claims he was sacked because of commencing disciplinary action against a cousin of the two bank chiefs.
Mr Cherono directed Mr Kamweti to reply to the objections and scheduled the hearing for September.
