Shinyalu MP Justus Kizito who was arrested in Kakamega town on Thursday following a warrant of arrest issued by a Kakamega court has been released on a Sh100,000 bond.

Mr Kizito was presented in court on Friday morning alongside his co-accused Charles Muhanji and Zakaria Musala under tight security.

The courtroom was full of the MP’s supporters before his arrival, prompting orderlies to push them aside to create space for other suspects who were appearing before Chief Magistrate Noela Ake.

Mr Kizito was joined at the court by three members of the Kakamega County assembly and his lawyer, Flavian Mulama.

The MP and the two co-accused faced charges of malicious damage to property on February 2, 2021.

He was accused of destroying two semi-permanent houses and a wooden fence belonging to Ms Sabeti Muteku's family at Vukutsa village.

The family is embroiled in a land dispute with Vukutsa primary school.

All the accused denied the charges.

Mr Kizito was charged separately with a second count of resisting lawful arrest and creating confrontation that caused harm to two police officers. He also denied the charge.

They were released on Sh100,000 bond each or cash bail of Sh50,000.

Upon his release, the MP mounted a convoy and moved round the streets in Kakamega town before he addressed his supporters at Oilibya petrol station.

He claimed the arrest was a political ploy from his political detractors who were out to intimidate him after he announced his interest to contest for the Kakamega governorship seat in 2022.

“However much they arrest me, I will not be intimidated in my quest of becoming the second governor of Kakamega. I will not bow from defending public utility and fighting for the rights of the people of Kakamega,” he said.

He rallied support for ODM leader Raila Odinga’s presidential bid saying the former premier will address injustices in the police and judiciary so that each Kenyan enjoys their freedoms without unnecessary arrests.
